I-9 COVID-19 Flexibilities Ending Soon

Employers Must Complete Required I-9 Physical Document Verification by August 30, 2023

The U.S. Department of Homeland Security (DHS) and U.S. Immigration and Customs Enforcement (ICE) announced that employers will have 30 days to achieve compliance with Form I-9 requirements after the COVID-19 flexibilities sunset on July 31, 2023.

First announced in March 2020 and subsequently extended throughout the COVID-19 pandemic, these flexibilities allowed employers to review employees’ identity and employment authorization documents virtually, with physical inspection to occur within 3 business days after normal operations resumed. DHS encourages employers who have been using these temporary flexibilities to plan ahead to ensure that all required physical inspection of identity and employment eligibility documents is completed by Aug. 30, 2023 for affected employees hired on or after March 20, 2020. Find full details here.
